Action Filed Against Directv for Same-Sex Sexual Harassment
Los Angeles, Dec. 18 - Carlos Sosa, a former executive of DIRECTV filed a demand for arbitration with JAMS and a lawsuit in Los Angeles Superior Court alleging that DIRECTV and one of its male executives violated the law by sexually harassing him and then terminating his employment when he complained. Mr. Sosa's lawsuit alleges that the executive, Steven Rock, engaged in a campaign of overt hostile work environment sexual harassment against him including:
The complaint alleges that defendant Rock sent Mr. Sosa sexually explicit e-mails, instant messages, and text messages.
The complaint further alleges that defendant Rock defaced Mr. Sosa's office with pornographic graffiti.
The complaint avers that defendant Rock described his sexual life in excruciating detail to Mr. Sosa.
The complaint also avers that defendant Rock hugged and/or tried to hug and/or otherwise touch Mr. Sosa in an inappropriate manner whenever defendant Rock saw Mr. Sosa.
The complaint also alleges that defendant Rock wanted to have a sexual relationship with Mr. Sosa.
JAMS has not yet assigned the arbitration a case number. Mr. Sosa's lawsuit in Los Angeles Superior Court was assigned case number BC 363475. Mr. Sosa is asking that the Los Angeles Superior Court declare that a provision in the arbitration agreement providing for expanded appellate review of any arbitration award was unlawful.
Commenting about these allegations, Mr. Sosa's attorney, Andrew H. Friedman of Venice-based Helmer • Friedman, LLP said: "I think it is horrible that the law allows companies, like DIRECTV, to force their employees, upon pain of termination, to sign binding, take-it-or-leave-it, arbitration agreements and thereby waive their constitutional rights to our court system. Mandatory arbitration not only prevents the public from learning about serious violations of the law but also favors big corporations who, as repeat-players, have the power to put out of business those arbitrators who rule against them."
